represalias seg\u00fan la Ley de Empleo y Vivienda Justa de California (FEHA, por sus siglas en ingl\u00e9s) se refieren a cualquier acci\u00f3n adversa tomada por un empleador, gerente o compa\u00f1ero de trabajo contra un empleado debido a que el empleado particip\u00f3 en una actividad protegida. Esto puede incluir el despido, la degradaci\u00f3n, la reducci\u00f3n de horas de trabajo, el traslado del empleado a un puesto menos deseable, evaluaciones negativas injustificadas, mayor escrutinio, o cualquier otra acci\u00f3n que probablemente disuadir\u00eda a una persona razonable de participar en actividades protegidas.<\/li>\n<li><strong>Causalidad<\/strong>: Para establecer un caso de represalia, un empleado debe demostrar que la acci\u00f3n laboral adversa fue tomada debido a su participaci\u00f3n en una actividad protegida. Debe existir un v\u00ednculo causal entre la actividad protegida del empleado y la conducta de represalia del empleador.<\/li>\n<li><strong>Defensa del Empleador<\/strong>: Los empleadores acusados de represalias bajo la FEHA pueden defenderse demostrando que la acci\u00f3n adversa fue tomada por razones leg\u00edtimas y no de represalia, como un desempe\u00f1o laboral deficiente o una reducci\u00f3n de personal.<\/li>\n<li><strong>Compensaciones<\/strong>: Los empleados que demuestren que fueron sometidos a represalias pueden tener derecho a compensaciones, incluyendo la reincorporaci\u00f3n, el pago retroactivo, la promoci\u00f3n, da\u00f1os por angustia emocional y honorarios de abogados.<\/li>\n<\/ol>\n<p>Espec\u00edficamente, el estatuto pertinente establece que es ilegal que un empleador \u00abdiscrimine contra cualquier persona porque la persona se ha opuesto\u00bb a actos de acoso o discriminaci\u00f3n.
