salarios y horarios en California est\u00e1n dise\u00f1adas para proteger a los trabajadores de ser explotados por sus empleadores. Desafortunadamente, muchos empleadores violan estas leyes y se aprovechan de sus empleados.<\/p>\n<p>Las violaciones comunes de las leyes estatales de salarios y horarios en California incluyen:<\/p>\n<p><strong>1) No pagar el salario m\u00ednimo. <\/strong><\/p>\n<ul>\n<li>El salario m\u00ednimo en California a partir del 1 de enero de 2023 era de $15.50. A partir del 1 de enero de 2024, el salario m\u00ednimo es de $16.00 independientemente del tama\u00f1o de la empresa.<\/li>\n<li>Muchas ciudades y condados de California tienen un salario m\u00ednimo m\u00e1s alto. Esa renuncia generalmente es firmada por usted al inicio de su empleo.<\/li>\n<\/ul>\n<p><\/li>\n<p> \t<\/p>\n<li>Adem\u00e1s, los empleados que trabajar\u00e1n m\u00e1s de diez (10) horas en un d\u00eda deben recibir un segundo descanso para comer de treinta (30) minutos. El empleado puede renunciar al segundo descanso si no renunci\u00f3 al primer descanso para comer y no trabajar\u00e1 m\u00e1s de doce (12) horas en el d\u00eda<\/li>\n<p> \t<\/p>\n<li>La mayor\u00eda de los empleados de California tambi\u00e9n deben recibir un descanso pagado de diez minutos (10 minutos) por cada cuatro (4) horas trabajadas.<\/li>\n<p> \t<\/p>\n<li>Si su empleador le hace trabajar durante su descanso para comer o per\u00edodo de descanso, debe recibir una paga premium, que es equivalente a una (1) hora de trabajo por cada descanso perdido.\n<ul>\n<li>Por ejemplo, si perdi\u00f3 un descanso para comer y un per\u00edodo de descanso durante un d\u00eda determinado, deber\u00eda recibir dos (2) horas de pago adicional a su tarifa regular de pago por hora.<\/li>\n<p> \t<\/p>\n<li>La paga premium debe figurar en sus declaraciones de salarios. Si no es as\u00ed, su empleador es responsable ante usted por sanciones civiles por emitirle una declaraci\u00f3n de salarios inexacta.<\/li>\n<p><\/ul>\n<p><\/li>\n<p><\/ul>\n<p><strong>5) Clasificar err\u00f3neamente a los empleados como exentos de los requisitos de salarios y horarios.<\/strong><\/p>\n<ul>\n<li>El hecho de que usted reciba un salario no significa necesariamente que est\u00e9 exento de las leyes de salarios y horarios.
