However, relief options are available:<\/p><h3><strong>Mortgage Forbearance \u2013 AB 238 (<em>Pending Legislation<\/em>)<\/strong><\/h3><p>Currently, legislation is moving forward to make it easier for LA County homeowners experiencing financial hardship from the fires. <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202520260AB238\">Assembly Bill 238<\/a> would authorize affected homeowners to pause mortgage payments for up to 180 days with no fees, penalties or interest, and extend for another 180 days upon request.<\/p><p>To request mortgage forbearance, a homeowner would need to:<\/p><ol><li>Submit a request to their mortgage loan servicer, and<\/li><li>Affirm that they are experiencing financial hardship during the wildfire disaster.<\/li><\/ol><p>The <strong>only <\/strong>requirement is the homeowner\u2019s self-attestation of financial hardship. The mortgage servicer <strong>cannot<\/strong> require additional documentation.<\/p><p>On Feb. 18, 2025, the bill was referred to the Committees on Budget and Finance and Judiciary for hearing.<\/p><h3><strong>NEW: $125 Million Mortgage Relief Program (<em>Pending Approval<\/em>)<\/strong><\/h3><p>On Feb. 19, 2025, Governor Newsom proposed a <a href=\"https:\/\/www.gov.ca.gov\/2025\/02\/19\/governor-newsom-proposes-125-million-in-mortgage-relief-to-benefit-victims-of-recent-natural-disasters\/\" target=\"_blank\" rel=\"noopener\">new mortgage relief program<\/a> that would provide <strong>$100 million<\/strong> in direct mortgage assistance for homeowners facing foreclosure due to recent natural disasters, with an additional <strong>$25 million<\/strong> to expand existing <strong>mortgage counseling services<\/strong> and FEMA disaster assistance guidance.<\/p><ul><li>Available to homeowners <strong>whose property was destroyed or substantially damaged<\/strong> in declared emergencies since Jan.\u00a0<strong>1, 2023<\/strong>.<\/li><li>To be considered at the California Housing Finance Agency meeting on<strong>\u00a0Feb. 20, 2025<\/strong>.<\/li><\/ul><h3><strong>Bank-Approved Mortgage Payment Relief<\/strong><\/h3><p>On Jan. 18, 2025, several federally and state-chartered banks <a href=\"https:\/\/www.gov.ca.gov\/2025\/01\/23\/governor-newsom-announces-commitments-from-state-banks-and-credit-unions-to-provide-mortgage-relief-for-firestorm-survivors\/\" target=\"_blank\" rel=\"noopener\">voluntarily agreed to assist homeowners<\/a> whose properties were damaged or destroyed by the wildfires:<\/p><ul><li>90-day forbearance from loan payments with no late fees or negative credit reporting.<\/li><li>Their agreement also suspends new foreclosure actions for at least <strong>60 days<\/strong>.<\/li><li><strong>How to Apply:<\/strong> Contact your lender and request <strong>wildfire hardship relief.<\/strong><\/li><\/ul><p><strong>Take Action Now<\/strong><\/p><p>Given the scale of the disaster, loan servicers may experience backlogs. Eviction Protections<br \/><\/strong><\/h2><h3><strong>NEW: LA County Six-Month Eviction Moratorium (<em>Pending Final Vote<\/em>)<\/strong><\/h3><p>Low-income renters who lost their jobs as a result of the fires will receive eviction protection upon the passage of a resolution that will face a second and final vote for approval by the LA County Board of Supervisors on Feb. 25, 2025.<\/p><p>Eligible tenants can stay in their home, motel, or rental unit without paying rent for up to 6 months, between <strong>Feb. 1, 2025<\/strong> and <strong>July 31, 2025<\/strong>.<\/p><p>To qualify, tenants must:<\/p><ul><li>Show at least a 10% loss in monthly income due to the fires.<\/li><li>Have a 2024 household income <strong>equal to or less than<\/strong> 150% of the Area Median Income.<\/li><li>Be enrolled in or have applied for a wildfire relief program and unemployment benefits or other income assistance program.<\/li><\/ul><p><strong>Importantly<\/strong>, tenants would be required to repay any rental debt incurred or still owed the landlord during the time of the protection within 12 months after the end of the State of Emergency.<\/p><h3><strong>California\u2019s Anti-Price Gouging Law<\/strong><\/h3><p>Governor Newsom\u2019s Jan. 7, 2025 declaration of a State of Emergency <strong>caps rent increases<\/strong> at 10% through March 8, 2025 (unless extended). This applies to Los Angeles and Ventura counties.<\/p><p>This protection, however, falls short of <a href=\"https:\/\/www.latimes.com\/california\/story\/2025-02-05\/los-angeles-city-council-committee-vote-eviction-protections\" target=\"_blank\" rel=\"noopener\">a bill that was rejected<\/a> by the Los Angeles City Council. Assembly Bill 246 proposed a sweeping rent freeze and eviction moratorium tied to the wildfires, mirroring previous COVID-era restrictions. The bill would have implemented a citywide rent freeze at price levels charged as of Jan. 7, 2025, prohibit evictions for non-payment of rent, and ban various other reasons for evictions.<\/p><p>AB 246 faced criticism by the California Apartment Association as being overly broad and lacking targeted relief because it would override the existing rent caps under California laws.<\/p><p>Although the bill was rejected, alternative tenant protections have been proposed.<\/p><p>On Feb. 14, 2025, a proposal to prohibit evictions for nonpayment of rent due to fire-related economic hardship <strong>failed once again<\/strong>. Additionally, a separate proposal to give tenants 3 months to repay back rent was also rejected after facing criticism from <a href=\"https:\/\/www.dailynews.com\/2025\/02\/18\/la-city-council-to-determine-fate-of-eviction-defense-proposal\/\" target=\"_blank\" rel=\"noopener\">multiple council members.<\/a><\/p><p>Concerns included potential unintended consequences on the existing housing crisis and verification challenges for determining financial hardship.<\/p><p>Although the bill was rejected, the LA City Council is moving forward with other protections for tenants who have lost their homes or jobs in the wildfires.<\/p><h3><strong>New LA City Ordinance: Eviction Prohibition for Sheltering the Displaced<\/strong><\/h3><ul><li>Effective Feb. 4, 2025, landlords cannot evict or raise the rent of tenants who temporarily house <strong>displaced tenants or pets<\/strong>.<\/li><li>Duration: One year.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7bdd3f3 elementor-widget elementor-widget-text-editor\" data-id=\"7bdd3f3\" data-element_type=\"widget\" id=\"insurance-protections\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2><strong>Insurance Protections<\/strong><\/h2><p>California law provides <strong>enhanced protections<\/strong> for homeowners facing coverage cancellations or expenses related to displacement from the fire.<\/p><h3><strong>Enhanced Insurance Coverage for Wildfire Survivors<\/strong><\/h3><p>The California Insurance Commissioner\u00a0has urged insurers to provide <strong>full contents coverage<\/strong>\u00a0for wildfire survivors <strong>without requiring a detailed inventory<\/strong>, recognizing the hardship of listing every lost item. While state law mandates advance payments of at least 30% of coverage, some insurers have already <strong>exceeded requirements<\/strong>, offering <strong>75-100% of policy limits upfront<\/strong>. To ensure their timeliness, the Commissioner is requiring insurers to respond to this request regarding their compliance by <strong>February 28, 2025<\/strong>. This initiative builds on <strong>existing consumer protections<\/strong> for those suffering total loss.<\/p><p>Source: <a href=\"https:\/\/www.insurance.ca.gov\/0250-insurers\/0300-insurers\/0200-bulletins\/bulletin-notices-commiss-opinion\/upload\/Notice-Re-Personal-Property-Insurance-Claims-for-2025-Los-Angeles-Wildfires.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow ugc\">Insurance Commissioner\u2019s website<\/a><\/p><h3><strong>Mandatory Moratorium on Insurance Cancellations<\/strong><\/h3><p>A mandatory one-year moratorium on cancellations and non-renewals of policies of residential property insurance went into effect when Governor Newsom declared the State of Emergency on Jan. 7, 2025.<\/p><p>Residential property insurers <strong>must reinstate <\/strong>homeowners\u2019 policies canceled or non-renewed due to wildfire risk since <strong>Jan. 7, 2025<\/strong>.
