What Happened: The Wage-and-Hour Claims
Under California labor law, non-exempt employees are entitled to strict wage protections and break requirements. In the case of Rogers Frank et al. v. Golf & Tennis Pro Shop, Inc. (Case No. 24STCV15688), nine named plaintiffs brought forth claims on behalf of a class of similarly situated non-exempt workers employed by GTPS in California between September 2019 and May 2024.
The lawsuit alleged that the employer systematically violated the California Labor Code by:
- Failing to pay employees for all hours worked.
- Denying workers their legally mandated, uninterrupted meal and rest periods.
- Failing to pay premium wages for those missed breaks.
- Providing inaccurate wage statements to employees.
Additionally, the lawsuit included claims under the Private Attorneys General Act (PAGA). This crucial legal mechanism allows employees to step into the shoes of the state to pursue civil penalties for Labor Code violations.
